End User License Agreement

  1. Quotations are valid for a period of 30 days , except as otherwise defined in contract.
  2. All prices fees and charges are exclusive of VAT which will be charged at the current rate. In respect of contracts carried out in the European Union outside of the Republic of Ireland, VAT will be charged at 0% (zero) rate on condition that the client is registered for VAT and provides details of a valid VAT registration number.
  3. Contract Duration.
    The minimum contract shall be for 1 years from the date of signing. The contract shall renew annually and Fijowave will give customer notice of an upcoming renewal date at least 30 days in advance. Customer may contact Fijowave any time during this 30-day period to cancel or alter the contract, after which time the contract shall be deemed renewed. Notice of intention to cancel an account should be emailed to accounts@fijowave.com.
    Where a Customer wishes to terminate their contract in advance of the end of their current contract period, they shall be liable to Fijowave for payment of the remainder of the applicable contract duration.
    Fijowave reserve the right to discontinue the service at any time subject to a notice period of 30 days. Pricing.
    Prices are fixed for the initial one-year term but are subject to change from year 2 onwards. Notice of change will be given to the customers at time of renewal.Note: In a rental model Fijoport unit remains the property of Fijowave and Fijowave reserves the right to have the unit returned at end of contract period.
  4. Payment Terms:
    As per customer quotation.
  5. Initial connection
    Customer’s account shall be activated immediately upon payment of any associated fees or charges.
  6. Service levels
    Fijowave may monitor the use of services for violations of this Agreement and/or of our Terms & Conditions of Service. In circumstances where Customer breaches, or is reasonably suspected to have breached, the Terms of this Agreement and/or of our Terms & Conditions of Service, or where we consider it necessary to protect service or Fijowave, its affiliates, directors, agents, employees or customers from harm, Fijowave may remove or block all communications, terminate this agreement or suspend or block customer’s access to their account, without notice and without any liability whatsoever to Fijowave.
  7. Consequential Loss:
    The Company will not be liable for incidental or consequential loss or damage exceeding the value of the contract. Nor will it be liable for any property damage except any such caused by The Company’s negligence.
  8. Customer support and account maintenance services
    While in a valid contract for service, customers shall have access to customer service and support via email. Types of service offered include support relating to technical, account management and general information enquiries. Customer service and support may be contacted as follows:

  9. Law and jurisdiction
    This Agreement shall be governed by and construed in accordance with the laws of Ireland and shall be subject to the exclusive jurisdiction of the Irish Courts.
